The regulation is not optional
LMT batteries, industrial batteries above 2 kWh and electric vehicle batteries need a Digital Product Passport from 18 February 2027 (Article 77(1) of the EU Battery Regulation). Under the ESPR, other product groups need one only after a delegated act for that group is adopted and applies; the Commission working plan gives 2027 as the indicative adoption year for textiles and tyres, and no such act had been adopted as of 26 September 2026.
